Zaten projelendirmeyi kendiniz yapsan\u0131z bile b\u00fcy\u00fck bir ihtimalle yasal olarak m\u00fcellif olamayaca\u011f\u0131n\u0131z i\u00e7in yerel bir proje ofisinin verece\u011fi hizmetler zorunlu olacakt\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00dclkemizde ise her il ve il\u00e7ede imar kurallar\u0131 de\u011fi\u015febilmektedir. Genel kavramlar ayn\u0131 olsa da belediye meclislerince al\u0131nan baz\u0131 \u00f6zel kararlar veya emsal te\u015fkil eden \u00f6nceden yap\u0131lm\u0131\u015f uygulamalar sebebi ile imar mevzuat\u0131 \u00e7ok farkl\u0131 \u015fekillerde uygulanabilmektedir. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ayr\u0131ca baz\u0131 durumlarda ve \u00f6zel projelerde yetki yerel y\u00f6netimlerden al\u0131n\u0131p \u00e7evre ve \u015fehircilik bakanl\u0131\u011f\u0131n\u0131n kapsam\u0131na sokularak \u00f6zel imar uygulamalar\u0131 yap\u0131labilmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Biz genel kavramlardan ba\u015flayarak \u00f6rnek bir in\u015faat alan\u0131 hesaplama \u00e7al\u0131\u015fmas\u0131na burada yer verece\u011fiz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00d6ncelikle <a href=\"https:\/\/hastanemimari.com\/wp-content\/uploads\/2022\/11\/Planli_Alanlar_Imar_Yonetmeligi16112022-1.pdf\">Planl\u0131 Alanlar \u0130mar Y\u00f6netmeli\u011finden<\/a> bahsedelim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Y\u00f6netmeli\u011fin 2. Maddesinde &#8221; Bu\u00a0<strong>Y\u00f6netmelik<\/strong>, uygulama\u00a0<strong>imar plan\u0131<\/strong>\u00a0bulunan\u00a0<strong>alanlar\u0131 kapsar<\/strong>.&#8221; demektedir. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130kinci kayna\u011f\u0131m\u0131z <a href=\"https:\/\/hastanemimari.com\/wp-content\/uploads\/2022\/11\/Plansiz_Alanlar_Imar-_Yonetmeligi.pdf\">Plans\u0131z Alanlar \u0130mar Y\u00f6netmeli\u011fidir.<\/a> Ayn\u0131 \u015fekilde 2. maddesinde bu y\u00f6netmelik kapsama alan\u0131 a\u015fa\u011f\u0131da belirtilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu Y\u00f6netmelik h\u00fck\u00fcmleri;<br>1) \u0130mar plan\u0131 bulunmayan ve\/veya son n\u00fcfus say\u0131m\u0131na g\u00f6re n\u00fcfusu <strong>10.000 in alt\u0131nda olan belediyelerin<\/strong> yerle\u015fik alan s\u0131n\u0131rlar\u0131 i\u00e7inde,<br>2) Belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7indeki <strong>k\u00f6y ve mezralar\u0131n<\/strong> yerle\u015fik alanlar\u0131nda,<br>3) Belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131nda <strong>imar plan\u0131 bulunmayan k\u00f6y ve mezralar\u0131n<\/strong> yerle\u015fik alanlar\u0131 ve<br>civar\u0131nda,<br>4) Belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde veya d\u0131\u015f\u0131nda <strong>imar plan\u0131 ve yerle\u015fik alan s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131nda kalan iskan d\u0131\u015f\u0131alanlarda<\/strong>, uygulan\u0131r.<br>5 ) 3\/5\/1985 tarihli ve 3194 say\u0131l\u0131 \u0130mar Kanununun 8 inci maddesinin birinci f\u0131kras\u0131n\u0131n (\u011f) bendi kapsam\u0131nda b\u00fcy\u00fck\u015fehir belediyelerince tespiti yap\u0131lm\u0131\u015f olup <strong>uygulama imar plan\u0131 bulunmayan k\u0131rsal yerle\u015fik alan ve civar\u0131nda<\/strong> uygulan\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. Kayna\u011f\u0131m\u0131z ise b\u00fcy\u00fck\u015fehirler i\u00e7in kendi \u00f6zel imar y\u00f6netmelikleridir. <br><a href=\"https:\/\/hastanemimari.com\/wp-content\/uploads\/2022\/11\/istanbul_imar-yonetmeligi.pdf\">\u0130stanbul \u0130mar Y\u00f6netmeli\u011fini<\/a> payla\u015f\u0131yorum. Bu y\u00f6netmelik i\u00e7inde Madde 1.01&#8217;de ve 1.02&#8217;de  kapsam\u0131 a\u015fa\u011f\u0131daki gibi belirtilmi\u015ftir.<br><br>&#8220;Bu y\u00f6netmeli\u011fin amac\u0131, <strong>\u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi <\/strong>s\u0131n\u0131rlar\u0131 i\u00e7erisindeki yerle\u015fme yerleri ile yap\u0131la\u015fmalar\u0131n, kanun, t\u00fcz\u00fck, imar planlar\u0131 ve y\u00f6netmelik h\u00fck\u00fcmleri ile fen, sa\u011fl\u0131k ve \u00e7evre \u015fartlar\u0131na uygun te\u015fekk\u00fcl\u00fcn\u00fc sa\u011flamakt\u0131r.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Bu y\u00f6netmelik, \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi, il\u00e7e ve ilk kademe belediyeleri s\u0131n\u0131rlar\u0131 i\u00e7inde uygulan\u0131r.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3194 say\u0131l\u0131 \u0130mar Kanunu hakk\u0131nda;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3194 say\u0131l\u0131  \u0130mar Kanunu yerel y\u00f6netimlerin kuvvetlenmesinin sa\u011flanmas\u0131 maksad\u0131yla olu\u015fturulmu\u015f bir kanundur. Bu a\u00e7\u0131dan 09.03.1985 tarihli 3194<br>say\u0131l\u0131  \u0130mar Kanunu\u2019nun getirmi\u015f oldu\u011fu \u00f6nemli \u00f6zellikler \u015funlard\u0131r.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130mar planlamas\u0131n\u0131  bir sistem dahilinde y\u00fcr\u00fct\u00fclmesini sa\u011flam\u0131\u015ft\u0131r. Sosyo-ekonomik etmenleri fiziki planlara dahil edilmesini sa\u011flam\u0131\u015ft\u0131r.<\/li>\n\n\n\n<li>Plan kapsam\u0131nda olan ya da olmayan b\u00f6lgelerin bir b\u00fct\u00fcn olarak de\u011ferlendirilmesini sa\u011flam\u0131\u015ft\u0131r.<\/li>\n\n\n\n<li>\u0130mar plan\u0131n olu\u015fturulmas\u0131nda ve uygulanmas\u0131nda belediyeler ile valiliklerin sorumluluklar\u0131n\u0131 art\u0131rm\u0131\u015ft\u0131r. Ayr\u0131ca imar planlar\u0131n\u0131n onaylanmas\u0131yla alakal\u0131 olarak belediyelere ve valiliklere yetki tan\u0131m\u0131\u015ft\u0131r.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u00dclkemizdeki gecekondula\u015fma durumu ,projesiz, ruhsats\u0131z in\u015faat ger\u00e7e\u011fi g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda 3194 say\u0131l\u0131 \u0130mar Kanunun gecikmi\u015f bir kanun oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Bu kanun yerel y\u00f6netimlerin \u0130mar konusunda yetkilerini artt\u0131rarak denetimlerin g\u00fc\u00e7lenmesini plan proje ve ruhsat  dahilinde yap\u0131 \u00fcretiminin olu\u015fmas\u0131n\u0131 sa\u011flam\u0131\u015ft\u0131r. \u0130mar plan\u0131 ve ruhsat uygulamas\u0131n\u0131n s\u0131k\u0131 bir \u015fekilde denetlenmesi s\u00fcreci 90&#8217;l\u0131 y\u0131llar\u0131n sonunda ba\u015flam\u0131\u015f ve 2000&#8217;li y\u0131llar itibari ile devletin g\u00fc\u00e7lenmesi ile birlikte g\u00fc\u00e7lenerek devam etmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Genel Kavramlar:<\/strong><br><strong>Kaks:<\/strong> Kat alan\u0131 kat say\u0131s\u0131 = Emsal <br>Kaks veya Emsal kavram\u0131 imar durumlar\u0131nda yer alan ve ger\u00e7ekten ne oldu\u011funu tarif etmenin zor oldu\u011fu bir kavrama d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. \u00dclkemizde m\u00fcteahhitlerin ve siyaset\u00e7ilerin in\u015faat alan\u0131na m\u00fcdahaleleri ve halk\u0131m\u0131z\u0131n kurallar\u0131 de\u011fi\u015ftirmekteki \u00e7abas\u0131na ra\u011fmen imar planlar\u0131 ile belirlenen ve  de\u011fi\u015ftirilmesi  bakanl\u0131k\u00e7a  projeye \u00f6zel imar verilmesi d\u0131\u015f\u0131nda m\u00fcmk\u00fcn olmayan olmayan <strong>emsal <\/strong>de\u011ferleri neyin emsalin i\u00e7ine girdi\u011fi neyin girmedi\u011fi konusundaki de\u011fi\u015fiklikler ile defalarca m\u00fcdahaleye u\u011fram\u0131\u015ft\u0131r. <br><br>Biz proje hesaplamalar\u0131nda  <strong>Kaks<\/strong> dedi\u011fimiz kat alan\u0131 katsay\u0131s\u0131n\u0131 net in\u015faat alan\u0131 ile \u00e7arparak bir ara de\u011fer elde ediyoruz. Bu de\u011fer ile birle\u015ftirece\u011fimiz bir\u00e7ok veri olabiliyor. Bu verileri de yine imar y\u00f6netmeliklerinden alaca\u011f\u0131z. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00d6rnek vermek gerekirse 1000 m2 net alan\u0131 olan bir arsan\u0131n <strong>Kaks <\/strong>de\u011feri <strong>2,07 <\/strong>olarak belirlenmi\u015f ise ;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Toplam Emsal<\/strong> = 1000&#215;2,07 =2070,00 m2 dir.  Bu rakam bize ruhsatland\u0131r\u0131labilecek alanlar i\u00e7in bir say\u0131sal de\u011fer sunmaktad\u0131r. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130stanbul \u0130mar Y\u00f6netmeli\u011fi&#8217;nde Kaks a\u015fa\u011f\u0131daki \u015fekilde tariflenmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yap\u0131n\u0131n b\u00fct\u00fcn katlardaki alanlar\u0131 toplam\u0131n\u0131n imar parseli alan\u0131na oran\u0131ndan elde edilen say\u0131d\u0131r<\/strong>. Katlar Alan\u0131 (KA) bodrum kat, asma kat, \u00e7at\u0131 aras\u0131 piyesi ve a\u00e7\u0131k\/kapal\u0131 \u00e7\u0131kmalar dahil kullan\u0131labilen b\u00fct\u00fcn katlar\u0131n katlar alan\u0131na dahil edilmeyen alanlar\u0131 \u00e7\u0131kt\u0131ktan sonraki alanlar\u0131 toplam\u0131d\u0131r.
